Australia is Expanding pathways to PR for temporary skilled sponsored workers

Australia is extending pathways to Permanent Residency for Sponsored Skilled Temporary Workers. With effect from November 25, 2023 (awaits regulatory approval), the Australian Government planning to implement changes to the Temporary Skill Shortage (TSS) visa subclass 482 and the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) visa subclass 186.

These changes aim to create a more straightforward and transparent path to permanent residency for TSS visa holders, offering better certainty to both employers and visa holders and supporting Australia in luring and retaining the skilled workforce it requires.

Temporary Skill Shortage (subclass 482)

  • Starting from November 25, 2023, the Government plans to remove the cap on the number of Short-term stream TSS visa applications that visa holders can submit within Australia. 
  • This adjustment will apply to new TSS visa applications made on or after November 25, 2023. 
  • Short-term stream TSS visa holders with visas set to expire before November 25, 2023, will be required to leave Australia to lodge a 3rd short-term stream TSS application.

Employer Nomination Scheme (subclass 186) Temporary Residence Transition Stream

The proposed changes to TRT stream nomination requirements include: 

  • Allowing employers to nominate visa holders from all TSS visa streams, comprising Short-term and Labour Agreement streams. 
  • Eliminating the necessity for nominated occupations in the TRT stream to be evaluated against a skilled migration occupation list.
  • The nominated occupation must be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO), and the nominated worker must continue to work in the occupation nominated for their TSS visa(s). 
  • Reducing the time a TSS visa holder must hold their visa and work in their nominated position or occupation to be eligible for nomination by their employer for the TRT stream to two out of the 3 years before the nomination.

These changes to TRT stream nomination requirements are expected to apply to new ENS and Regional Sponsored Migration Scheme nomination applications and pending applications as of November 25, 2023.

Proposed changes to TRT stream visa application requirements include:

  • Updating age exemptions for regional medical practitioner applicants and high-income earning applicants aged 45 years and above to create a 2-year pathway. 
  • Discontinuing COVID-19-related age exemptions that will no longer be relevant due to the introduction of the 2-year pathway.

These changes signify the primary phase of offering more equitable access to permanent residency for all TSS visa holders. The government will continue its efforts to reform the skilled visa programs, constructing on the development of the Government's Migration Strategy Outline and the findings of the 2023 Review of the Migration System.
