Canada clarifies the criteria for Digital Nomads arriving in Canada

The Immigration Refugees and Citizenship Canada (IRCC) has released the policy update on January 30, 2024 describing the specific information relevant to foreign individuals seeking to engage in remote work on Canada Digital Nomad Visa.

Who is a Digital Nomad?

As per the IRCC's description, a digital nomad is an individual capable of carrying out their employment responsibilities from any location worldwide.

Criteria that could affect a 'digital nomad' in Canada

As per announcement of Canada’s Tech Talent Strategy in 2023, IRCC has clarified the requirements that could affect a 'digital nomad'.

How long a Digital Nomad Can stay in Canada?

A digital nomad only require visitor status to move to Canada for up to 6 months at a time while they perform their job remotely for an overseas employer or, if they are self-employed, working for themselves or offering services to clients outside of Canada.

Can a Digital Nomad work for a Canadian employer?

A person may arrive in Canada as a digital nomad to work remotely, however, s/he need to first get a work permit if they find a Canadian employer after entry. If an intent to find a Canadian employer is declared while applying, they must be informed that a work permit will be required before starting work for such an employer.

What additional documentation required for a digital nomad visa?

Well, no additional documentation is required of a person arriving in Canada to be a digital nomad (although they must still convince the officer that they will leave Canada at the end of their authorized stay).

When a Digital Nomad should apply for a work permit?

In case digital nomads find a Canadian employer ready to hire them, they require applying for a Canadian work permit.

The family members of digital nomads who are willing to work or study in Canada should apply for a work permit or study permit.

Open Work permit for H-1B specialty occupation visa holders

As part of its Tech Talent Strategy, Canada is also enhancing labour mobility within North America by introducing a efficient work permit for H-1B specialty occupation visa holders in the US seeking employment opportunities in Canada.

  • Many professionals in the high-tech sector work for organizations with extensive operations in both the US and Canada. Those presently holding H-1B specialty occupation visas in the US will have the opportunity to apply for entry into Canada as of July 16, 2023, along with their immediate family members. 
  • Successful candidates will be granted an open work permit valid for up to 3 years, enabling them to work for any employer across Canada. Moreover, spouses and dependents can apply for a temporary resident visa, including a work or study permit as required. This initiative aims to facilitate cross-border employment for skilled individuals in the tech industry.
