Now, this latest news has come as the cherry on the cake for visitors to these countries. The government of Canada and USA are now allowing the visitors to apply for the job while being on a Canada/ USA Visitor visa.

The people who are in Canada or USA on Visitor visa, can now apply for job and subsequently, convert their Visitor Visa status in to Work permit or employment-authorized status based on the received employment offer. Let’s find out more about this new measure one by one for both the countries.

Apply for job as a tourist in Canada

Canada Visitor visa allows you to stay in Canada for a limited period, usually up to 6 months. On 28 February 2023, the government of Canada has extended its temporary public policy of allowing job application on Visitor visa for 2 years, i.e. until February 28, 2025. • It means, once you have reached Canada on Visitor Visa, you can search for suitable job, obtain a Job offer and subsequently, apply for a work permit. 

• The work permit allows you to work lawfully in Canada and earn a living while exploring the maple leaf country. 

Apply for job as a tourist in USA

The B1/B2 Visa is a short term (i.e. 6 month) non-immigrant visa for the people who want to travel down to USA for different purposes.

• The B1 Visa (Business) is for the people who wish to travel to US for business meeting or to negotiate a contract etc.
• US B2 Visa (Tourism) is for the people who wish to visit USA for tourism, vacation or for medical treatment, etc.

As per the latest statement issued by United States Citizenship and Immigration Services (USCIS) on March 22, 2023, “searching for employment and interviewing for a position are permissible B-1 or B-2 activities.” Here are a few key points to remember regarding this measure: 

• As per USCIS, if you are in B-1 or B-2 status, you may not engage in employment within the domestic labor market, while in B-1 status or engage in any employment while in B-2 status.
• Before starting any new employment, a petition and request for a change of status from B-1 or B-2 to an employment-authorized status must be approved, and the new status needs to take effect.
• Otherwise, if the change of status request is rejected or the petition for new employment requested consular or port of entry notification, the person must depart the U.S. and be admitted in an employment-authorized classification before commencement of the new employment.
