U.S. waves Interview Requirement for Certain Non-immigrant visas Effective January 1, 2024

With effect from January 1, 2024, the U.S. Department of State (DOS) has expanded interview waivers for additional non-immigrant visa applicants. The US Non-immigrant visas chiefly includes Visit Visa as well as the popular Study visa. Renewal applicants within 48 months of the prior visa's expiration in the same classification are now eligible.

Identified  Key Visa Categories

Following discussions with the Department of Homeland Security, the Secretary of State has identified particular categories for interview waivers, considering them in the national interest. Consular officers now have the right to waive in-person interviews for:

  • First-time H-2 visa applicants (temporary agricultural and non-agricultural workers).
  • Other non-immigrant visa applicants applying for any non-immigrant visa classification who were previously issued a non-immigrant visa in any classification, except a B visa, and are applying within 48 months of their most recent non-immigrant visa's expiration date.

Legal Requirements and Implementation Details

Applicants must fulfil certain legal requirements to become eligible for an interview waiver. The employment of this authority begins on January 1, 2024, and will undergo an yearly review, effective until further notice.

Continued Eligibility for Renewal Applicants:

The applicants renewing a non-immigrant visa in the same classification within 48 months of the previous visa's expiration date continue to be eligible for interview waivers until further notice.

Criteria for Interview Waiver Eligibility

To be eligible for an interview waiver, applicants need to:

  • Apply in their country of nationality or residence.
  • Have never been refused a visa unless such refusal was overcome or waived.
  • Have no apparent or potential ineligibility.

The US consular officers may still require in-person interviews on a case-by-case basis or due to local conditions.
