UK’s New Point Based Immigration System to Begin from 1st January 2021

With the end of the freedom of movement between UK and European Union, on 31st December 2020, the United Kingdom has confirmed the start of a new Point Based Immigration System.

This new immigration system will be a fair system and will based on the policy of UK government, i.e. treating people from different parts of the world equally. The point system will be streamlined and user friendly, which will make best use of technology and apply the recommendations of the law commission.

Key requirements of the UK New Point based Immigration System

  • The European and Non- European citizens, willing to live and work in United Kingdom from 1st January 2021, require showing their Right to be in UK as well as the eligibility you have. All the candidates will get the written confirmation of their current immigration status.
  • EU and non-EU applicants, eligible to work in the UK, will be able to use an online service to show the right to work in the United Kingdom. This online service is active and operational since January 2019 and makes right to work instructions easier for employers, by making people’s right to work information available in real time and eliminating the requirement of physical document checks.

Biometrics

  • The non-EU citizens, and some EU citizens applying on particular pathways or who are not able to use the self-enrolment alternative, will require attending the global network of VACs, or if they are applying in the United Kingdom the in-country comparable, to provide facial images and (in the case of non-EU citizens) fingerprint biometrics, where needed.
  • In long term, UK wants all visitors and migrants to the UK to provide their biometric facial images and fingerprints under a single global immigration system. To avail customer ease of access and security, the government shall progressively look to offer proficiencies for biometric self-enrolment, incorporated within digital application processes for immigration products.

Application fee

  • The Application fees under the new system will continue to be the same, i.e. as per existing structure. It will be applicable to both EU and non-EU citizens.
  • The Immigration Skills Charge will be applicable to UK employers of skilled workers as per the existing structure of the same, except the government plan to remove the existing exemption for employers of EU, EEA and Swiss citizens after the end of free movement.

Skilled Workers - Who can apply?

  • The applicants from all nationalities (except British and Irish), who have a confirmed employment offer, and whose job will be sponsored by a UK employer with a Home Office licensed to work in identified occupations (at RQF3 or comparable and above).

Salary thresholds – a salary at or above the common threshold £25,600 or the standing rate, whichever is higher. May be reduced through tradeable points or being a new contestant to the labour market.
Skills threshold (RQF 3 and equivalent and above)

High Skilled Workers Route (No job offer required)

In the new point based immigration system, the UK will create a wider and unsponsored route, which will function along with the employment offer system. This pathway will allow a lesser number of the highly skilled workers to travel to the UK even without any job offer.

However, this pathway will not open on 1st January 2021 and the government is reviewing the proposals for this additional pathway with the stakeholders over the upcoming year. However, the fact to note is, this would be capped and would be cautiously examined during the implementation phase. The government will disclose further details regarding this soon.

Existing Global Talent Route

The government of United Kingdom is looking to lure the very best and brightest talent from across the globe. Hence, on February 20, 2020 UK launched the Global Talent route, under the present system for non-EU nationals, to enhance the United Kingdom’s appeal to highly skilled persons with specialist skills.

  • This is chiefly a work route. Applicants can study certain disciplines however for this he/she need to acquire an Academic Technology Approval Scheme (ATAS) certificate
